Legal Mechanisms for Survivors of Human Rights Abuses Matt Eisenbrandt

Many survivors of torture and other atrocities feel that achieving some measure of justice for the abuses they suffered is essential. In the United States, some survivors have been able to turn to the Alien Tort Claims Act and the Torture Victim Protection Act to bring lawsuits against individual perpetrators and corporations responsible for the abuses. This workshop will explore how the ATCA and TVPA have been used in U.S. courts, the experiences of survivors in these cases, and how much justice has actually been achieved. We will also look at whether these lawsuits appropriately address the rights of victims to reparations, and whether the United States should follow the criminal prosecution model adopted by other countries.
